Acceptable Use Policy
Introduction
FAB has designed this Acceptable Use Policy (AUP) for all users of the Findababysitter.com (FAB) site. The purpose of the AUP is to ensure your enjoyment of our services, the proper use of our services and to ensure that we comply with all relevant UK laws.
This AUP should be read in conjunction with our
Terms and Conditions which collectively govern your use of our services and the FAB website as a whole. It is your responsibility to ensure that at all times when you remain on our site you comply with the latest version of the AUP.
This AUP may be revised, without notice, at any time, at the sole discretion of FAB. In the event of a breach of this AUP, FAB reserves the right to terminate your account (without a refund).
This AUP is divided into three (3) parts:
Part 1) All Users of this website;
Part 2) Applies to Candidates; and
Part 3) Applies to Employers.
Definitions and Interpretations
“Candidate” shall mean: Nannies, Babysitters, Childminders, Private Midwives, Maternity Nurse, Governess, House keeper, Cleaner and or Tutor;
“Employer” shall mean a parent, parents and or agencies;
The term "You" & "User" are refer to all persons, individuals and/or entities using this Website for any reason. The term “us”, “we”, and or “our” shall refer to FAB.
Part 1)
The Law
As a user of the FAB website you agree not to engage in activities that could be construed as indecent, offensive or otherwise illegal nature. Any such activities may result in prosecution by the England and Wales authorities under the relevant Criminal Acts including but not limited to the Computer Misuse Act 1990, the Protection of Children Act 1978, the Criminal Justice Act 1988 and the Prevention of Harassment Act 1997. Users are advised that FAB cooperates fully with all law enforcements agencies in the England and Wales and other regions as well.
It is also a criminal offence under UK law to knowingly infringe intellectual property rights, such as copyright, patents, database rights and registered trademarks. Users are advised that FAB co-operates fully with all rights holders who seek to protect their rights.
Users are also advised that the Data Protection Act 1998 (DPA) imposes numerous duties upon FAB. FAB co-operates and adheres (if insofar as it is applicable) with the DPA and the enforcer of the DPA; the Information Commissioners Office.
Security
Users are advised that login names and passwords must be kept secret and not be communicated to any third party. If you are using our service as an Employer then you are advised to keep your password and login details to those members of your organisation and or household that needs to know these details.
Should you lose, forget or misplace any of your login details you are advised to notify FAB immediately.
Part 2)
This Part 2 applies to your use of the FAB website in your capacity as a Candidate.
Spam filter
As a Candidate you can purchase a Background Check provided by Experian Limited. This is a third party product and as such it is subject to a separate terms and conditions. We do not accept any responsibility for the purchase, use and or reliance on the background check.
Part 3)
This part 3 applies to your use of the FAB website in your capacity as an Employer.
Spam filter
The sending of spam emails and or messages disrupts the enjoyment and use of FAB’s services. FAB defines spam as the sending of the same (or similar) email to numerous other users of our website within a short space of time.
FAB operates a spam control feature. As an Employer if you contact more than
20 Candidates or other Employer’s within a twenty-four (24) period access to your account will be suspended. Access to your account will remain suspended until such time as FAB deems fit. Persistent breaches of our spam control feature may see your account terminated permanently.
Job Posting
As an Employer you are allowed to post jobs on our site. Your posts must be for legitimate roles and not to entice/recruit Candidates to sign up to your services (for example an agency). Should you post jobs that are not for legitimate roles then we reserve the right to remove your post without refund or recompense. We also reserve the right not to approve the uploading of any job post should we deem the post not to be for a legitimate role.
