• 1.1 The information contained on these pages are www.findababysitter.com's Terms & Conditions under which you may use www.findababysitter.com. www.findababysitter.com shall herein after be called FAB.

  Please read this page carefully. If you do not accept the Terms & Conditions stated here do not use this website & its services. The term "You" & "User" are herein after used to refer to all persons, individuals and/or entities using this website for any reason. By using this website You accept these Terms & Conditions. FAB reserves the right to modify & revise these Terms & Conditions at any time. Each time You use FAB you should review these Terms & Conditions as by using FAB You are bound by them.

  Candidate shall herein after be used to name Nannies, babysitters and other childcare professionals.

2. DESCRIPTION of the FAB SERVICE

• 2.1 FAB is an open medium where community members are able to post their details as nannies, babysitters or other childcarers. These details are subject to limited screening by FAB & will not appear on FAB until approved by FAB.
• 2.2 These details are available to persons seeking to employ a nanny &/or babysitter or other childcare professional. All contact details provided by persons registering with FAB as nannies &/or babysitters will be available to persons registering with FAB as parents.
• 2.3 FAB is not an agency. FAB works as a search tool for families seeking childcare to locate and contact childcarers living or willing to work in the areas where the families require childcare.

3. Use of the FAB website

• 3.1 The FAB website may only be used for lawful purposes by individuals and employers seeking childcare related information. The website may only be used by individuals seeking childcare employment, as a nanny or babysitter, and employers seeking private care for their child or children.
• 3.2 FAB prohibits the use of its website for the following, but not limited to, violations. All persons, individuals and otherwise, using the FAB website agree not to use, or allow any person, party or individual under their control use FAB for the following:
  • (a) False, incorrect or incomplete postings of biographical information or information which is inaccurate or not your own.
  • (b) Searching the FAB nanny and babysitter database for any purpose other than to find private care for your child or children.
• 3.3
  • (a) It is prohibited to use the FAB website in a way that is, or may be seen to be, defamatory, discriminatory (whether racist, sexist, prejudice or otherwise).
  • (b) It is prohibited to use the FAB website to (A) distribute, display or transmit information or content which of a commercial nature. (B) To distribute, display, transmit, store or destroy the FAB website content if it infringes on the copyright, trademark or other intellectual property rights of others or violate an individual's privacy or personal rights.
  • (c) It is prohibited for a user to access data not intended for such user. A user may not access or log into a server or account which the user has no authorization to access. It is prohibited to test, scan or probe the vulnerability of the FAB networks & systems or breach security.
  • (d) Attempting to interfere with a users ability to access or use the FAB website & services, their host or network by, but not limited to, the following means "spamming"; sending a virus; "flooding"; crashing; "mail bombing."
  • (e) Tampering or interfering with TCP/IP packet headers is forbidden.
  • (f) By violating any of the above and any other securities of the FAB systems or networks you risk civil or criminal liability.

4. USE of FAB CONTENT

FAB permits the use & download of a copy of the material provided on the website for your personal use only. The material provided on FAB is not for commercial use. All content provided by & on the FAB website & all other websites under FAB's control are protected under United Kingdom copyright & trademark laws. This includes graphics, software, text, images, logos, icons, button icons & all other website content. All the said content is the exclusive property of FAB. Unauthorized use of FAB's website content may violate copyright & trademark laws. You are in no way permitted to modify or sell the FAB website's content. If you use or copy any part or all of the FAB websites content, you must retain all copyright & trademark notices which were shown on the original website.

5. PROVISION of the SERVICE

FAB Users are permitted to search for nannies, babysitters and other childcare professionals. Such Users are permitted to view such person's personal details if the User has fully registered and paid for the service. Each User of FAB is permitted to post personal submissions regarding their desire and ability to find a childcare position. FAB charges solely for access to the personal contact details of nannies, babysitters and other childcare professionals. By registering with FAB You agree to provide accurate, current & complete information.

6. SCREENING & VETTING

• 6.1 FAB acts as a passive conduct for the online publication of User submitted information. Screening and vetting of User information is limited. FAB holds no obligation to screen information or communications in advance. FAB holds no responsibility for screening and vetting Nannies and Babysitters submitted information. The final decision to have communications and/or use information on the FAB site is at your own risk.
• 6.2 If notified by Users of FAB of communications and/or information which does not conform with the FAB Terms & Conditions, FAB may investigate an allegation and determine at its sole discretion whether to remove information or communication. FAB

7. PAYMENT by PERSONS SEEKING CHILDCARE

• 7.1 To gain full access to the service provided by FAB, Users seeking childcare need to select to fully follow subscription procedures. Users will also be required to select a membership criterion. Memberships must be paid in advance, full access to the website and candidates' details will only be made possible on receipt of payment. Payments may be made using the online payment system provided on the Website.
• 7.2 Payment is made for one of several membership options. It is up to you, the Users, sole discretion which membership selection you make.
• 7.3 Costs and terms of the membership criteria are available on the FAB website.
• 7.4 Once your membership has expired you will no longer have full access to candidates' details on the website. Access will be granted again once the proper membership fee has been paid.
• 7.5 The prices charged for each membership selection are the prices in force at the date and time of your subscription. FAB may alter and change the price of each membership selection. FAB tries to ensure prices are correct and accurate at all times but do not guarantee this. You the User have the right to cancel a membership order at the time of subscription if the price of the membership selection quoted differs from the actual price. Prices are exclusive of VAT and other applicable taxes. These taxes and VAT charges must be paid in addition by you.
• 7.6 Once FAB has received payment from you for your selected subscription FAB will confirm this by email. FAB reserves the right to refuse a membership subscription made by you.
• 7.7 You the User undertake to provide true and correct details for the purpose of subscribing to the FAB service and paying a membership fee to gain full access to the service. You the User undertake to provide true and correct credit, debit or any other electronic switch details, you undertake that the payment method and details you use are your own and that sufficient credit or funds are available to you to use at the time of a FAB membership purchase. These credit facilities and funds must be sufficient to cover the cost of your selected membership purchase.

8. CONDITIONS of ACCESS by PERSONS SEEKING CHILDCARE & CHILDCARERS SEEKING EMPLOYMENT to the SERVICE

• 8.1 You the user are granted access to the FAB website upon complete and thorough registration. Persons seeking childcare are granted full access to nanny, babysitter and other childcare professionals personal contact details upon payment of a FAB membership fee or during the term when FAB grants free membership to those persons registered with FAB and who are actively seeking childcare assistance. (see point 7. of these Terms and Conditions.)

9. CONTENT PROVIDED BY USERS of the SITE

• 9.1 By registering with FAB you agree to provide certain personal information herein after to be called "your information". FAB reserves the right to contact users with information and publicity material. FAB reserves the right to offer relevant third party, and otherwise, products & services to you the User. You agree also that FAB may disclose your information, in an anonymous fashion, to third parties. FAB will not disclose your name, telephone number, email address or postal address to any third party without your prior consent. FAB will only disclose such information to a third party when necessary or appropriate or to comply with applicable laws or in legal proceedings where such personal information is required and relevant.
• 9.2 Persons and Users registering as Nannies and/or Babysitters agree to have their personal information disclosed to persons and/or Users registered on the FAB website as parents or person's aiding parents who are actively seeking childcare.
• 9.3 You the User are responsible for all communications. You are also solely responsible for the consequences of posting information on the FAB website. By using the FAB website you agree not to: post obscene, offensive, defamatory, vulgar or abusive material; post material which may be seen to be harassing, hateful, sexist, racist, descriminative or prejudice in any way. You agree not to post material which may be seen as annoying, cause anxiety or inconvenience to another person or entity. You agree not to post copyright material without the explicit permission of the copyright owner; advertisements; chain letters. You agree not to impersonate another person; or material which contains viruses of any kind or use or post any other computer programming method that are intended to interfere with, corrupt or damage data or information.
• 9.4 FAB reserves the right to edit, omit or delete any information submitted by you to the website.
• 9.5 Information by Users of the website is not guaranteed by FAB nor does the information represent the views of FAB, the companies' directors or employees. FAB does not guarantee the truthfulness, reliability or accuracy of communications posted by Users of the FAB site. Nor does FAB endorse opinions expressed by Users. By registering and/or using the FAB website you agree that any reliance on any information contained within the FAB website or posted by Users of the FAB website is at your own risk.

10. LIMITATION of LIABILITY

• 10.1 FAB shall not be liable under any circumstances for any loss, damage, expense, or compensation suffered or incurred by the User either directly or indirectly arising from or in any way connected with FAB.
• 10.2 FAB does not guarantee the suitability of any candidate introduced to the User. The final decision to employ a candidate is the sole responsibility of the User. The User shall therefore satisfy themselves as to the suitability of the Candidate and the User shall take up any references provided by the Candidate to it before employing a Candidate. FAB does not accept any liability for any inconvenience, damage or loss arising whether caused directly or indirectly from any act or omission of a Candidate introduced to the User by FAB.
• 10.3 FAB offers no warranty for a nanny, babysitter or other childcare professionals character, honesty, reliability, suitability or capacity. Because of the nature of the Internet user authentication is difficult, therefore FAB does not guarantee or confirm that any user is who they claim to be.
• 10.4 FAB is not responsible for the User and Candidates contract of employment. These are to be arranged between the User and Candidate. FAB offers a contract of employment only as a guide for the User. FAB cannot and is not held responsible for user to user communications. By using the FAB website you agree to release FAB, our agents and employees, from claims, damages and demands of any kind arising out of or in any way connected with any dispute you the User may have with any other User of the website.
• 10.5 FAB will not be liable for death or personal injury resulting from its negligence.

11. DISCLAIMER of WARRANTIES

• 11.1 FAB does not guarantee the reliability or accuracy of content provided on the site. Nor does FAB guarantee that the service will be without fault or error. FAB does not guarantee that a Users specific requirements will be meet by the websites service.

12. GENERAL

• 12.1 You, the user, are responsible for your password and any information provided by you to the website. Any and all uses of your registration with the FAB website are your sole responsibility. Should there be any unlawful or unauthorized use of your password or registration You agree to notify FAB immediately.

13. JURISDICTION

These Terms & Conditions shall be construed in accordance with and governed by the laws of England and Wales/Scotland/Northern Ireland and the parties submit to the exclusive jurisdiction of the Courts of England and Wales/Scotland/Northern Ireland.
